These Terms of Service ("Terms") govern your use of the Entourage AI website, the early-access waitlist, and any collection kit, analysis or results service we make available ("the Service"). Entourage AI ("we", "us", "our") operates from San Rafael, California and Glasgow, United Kingdom. Please read these Terms carefully. If you do not agree with them, do not use the Service.
Acceptance
By visiting this site, joining the waitlist, creating an account or ordering a kit, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you are agreeing on behalf of an organisation, you confirm that you are authorised to bind that organisation, and "you" then means both you and that organisation.
If we publish a separate agreement for a specific arrangement, such as a clinic or laboratory partnership, that agreement prevails over these Terms to the extent the two conflict.
Eligibility
The Service is available to individuals aged 18 or over. By using it you confirm that you are at least 18, that the information you give us is accurate, and that you will keep it up to date. We do not knowingly provide the Service to anyone under 18, and we will close an account and delete the associated data if we learn that it belongs to a minor.
The Service may not be available in every country, and we may decline or cancel an order where we cannot lawfully ship a kit, process a sample or return results. Where the Service is available it is offered for personal use, not for clinical, forensic, employment, insurance or research purposes, unless we have agreed that in writing.
The service
Entourage AI uses proteomics, the analysis of thousands of proteins in your blood, to provide a deeper view of your biology over time. The Service is designed for those focused on long-term wellness.
The Service provides wellness information. It is not medical advice, it is not a diagnosis, it is not a diagnostic test, and it does not replace care from your clinician. Nothing we provide is intended to diagnose, treat, cure or prevent any disease or condition. Do not use the Service, or delay or disregard advice from a qualified health professional, in response to anything you read in your results. If you have an urgent health concern, contact a clinician or your local emergency service.
We may add to, change or withdraw features of the Service. Where a change materially reduces a feature you are actively paying for, we will give you notice of at least [X days] before it takes effect.
Accounts and early access
Some parts of the Service require an account. You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for everything done through your account. Tell us promptly at the address in the Contact section if you believe your account has been used without your permission.
The Service is currently offered as early access. That means features may be incomplete, may change, and may be withdrawn, and that we make no commitment about when any particular feature will be available. Joining the waitlist does not create an entitlement to the Service, to a place in any queue, or to a particular price. We may invite waitlist members in any order we choose, and we may limit the number of members we accept.
You may close your account at any time. We may suspend or close an account if you breach these Terms, if we are required to do so by law, or if continuing would create a risk to you, to us or to another member, and we will tell you why unless we are prevented from doing so.
Kits and samples
A kit contains what you need to take a small blood sample at home, or at a clinic or MedSpa of your choosing, and a prepaid envelope to return it in. Follow the instructions in the kit. Collection carries the ordinary minor risks of a finger or capillary sample, including discomfort, bruising or light bleeding; if you have a bleeding disorder, take anticoagulant medication or are unsure whether collection is appropriate for you, speak to a clinician first.
You must collect only your own sample, and you must not submit a sample taken from anyone else. You confirm that any sample you send is yours and that you are giving it voluntarily.
Kits have an expiry date and must be returned within [X days] of collection for the analysis to be reliable. We cannot guarantee a result where a sample is insufficient, damaged, contaminated, mislabelled, delayed in transit or outside the stated window. Where a sample fails for a reason within our control we will send a replacement kit at no charge. Where it fails for another reason, a replacement may be chargeable, and we will tell you before we charge you.
Title to a kit passes to you on delivery. A returned sample and the data derived from it are handled as described in the Privacy Policy. Samples are retained for [X days] after analysis and then destroyed, unless you have asked us in writing to destroy them sooner or a law requires us to keep them longer.
Results
Results are delivered online, in your dashboard, together with personalised insights. Typical turnaround is [X days] from the day the laboratory receives your sample, but this is an estimate rather than a promise.
Results describe patterns in the proteins measured in a single sample at a single moment. Proteomic measurements vary with recent illness, sleep, exercise, hydration, medication, time of day and other ordinary factors, and estimates such as biological age are statistical indicators, not clinical findings. Repeated measurements over time are more informative than any single one. Do not treat any figure in your dashboard as a diagnosis or as a reason to start, stop or change any treatment.
You are responsible for deciding whether to share your results with anyone, including a clinician. If you ask us to send results to a third party, we will act on that instruction until you withdraw it.
Acceptable use
You agree not to:
- use the Service unlawfully, or for any purpose other than your own personal wellness;
- submit a sample that is not your own, or give false information about yourself or a sample;
- resell, sublicense, or commercially exploit the Service, a kit, or any results;
- copy, scrape, reverse engineer or attempt to derive the models, methods or datasets behind the Service;
- interfere with the Service, probe or test its security, or access it by any means other than the interfaces we provide;
- upload anything harmful, or anything that infringes someone else's rights; or
- present the Service, or anything we provide, as a medical device, a diagnostic test or clinical advice.
We may investigate suspected breaches and take any step we reasonably consider appropriate, including suspending access.
Intellectual property
The Service, the site, the Entourage AI name and logo, and all software, models, methods, text, images and other material we provide are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service and to view and download your own results for your own non-commercial use. No other right is granted.
You keep all rights you have in your own sample and in the personal data derived from it. You grant us a licence to process that sample and data to provide the Service, and to use de-identified and aggregated data, which cannot reasonably be used to identify you, to operate, improve, validate and develop our models and the Service. We will not sell your identifiable personal data.
If you send us feedback or suggestions, you allow us to use them without restriction and without owing you anything for them.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure or error free, that results will be free of variation or error, or that any insight will be suitable for you or lead to any particular outcome. We make no claim about the effect of the Service on your health, your longevity or your biological age.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only so far as that law allows, and nothing in these Terms affects rights you have as a consumer that cannot be waived.
Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
Subject to that, and to the fullest extent permitted by law: we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profit, revenue, goodwill, opportunity or data, however it arises; and our total aggregate liability arising out of or in connection with the Service, whether in contract, tort (including negligence), statute or otherwise, is limited to the greater of the amount you paid us for the Service in the [X months] before the event giving rise to the claim, or [Amount].
You accept that the limits above are reasonable given the nature of the Service and the price at which it is offered, and that we would not offer the Service on these terms without them.
Changes
We may change these Terms. When we do, we will update the date at the top of this page and, where the change is material, give you notice of at least [X days] by email or through the Service before it takes effect. Changes apply from the date they take effect and do not apply retrospectively.
If you do not accept a change, stop using the Service and close your account before the change takes effect. Continuing to use the Service after that date means you accept the updated Terms.
Governing law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of [Jurisdiction], without regard to its conflict of law rules. The courts of [Jurisdiction] have exclusive jurisdiction, except that nothing prevents either party from seeking injunctive relief in any court of competent jurisdiction, and except where the mandatory law of your country of residence gives you the right to bring proceedings in your local courts.
Before starting proceedings, each party agrees to raise the issue in writing at the address below and to allow [X days] for the other to respond.
